In relation to the house in (al-Moghasil) valley in Sa'dah Governorate
Regarding the report issued by Amnesty International on (October 2015) stated that the Coalition Forces on (4 June 2015) dropped four bombs during successive airstrikes, breached neighboring civilians houses, killed (11) members of a local family, and injured (3) others in (al-Moghasil) area north of (Sa'dah) city.
JIAT verified the incident, examined all related documents, including the Procedures; Rules of Engagement, the Daily Mission Schedule, the After Mission Reports, the satellite images, the video recordings; and assessed all gathered evidence.
JIAT found that based on intelligence reports that indicate a presence of one of Houthi leaders as well as weapons storage and military equipment belong to Houthi armed militia in a (building and its annexes). Therefore, the legal protection of civil objects (building and its annexes) had been dropped for the use in the effective contribution of military action, which represents a high value legitimate military objective that its destruction achieves military advantage. On Thursday (4 June 2015) the Coalition Air Forces executed an air mission on the mentioned target located in an isolated and mountainous area in (al-Moghasil) valley in Sa'dah governorate, using (4) guided bombs proportional to the size of the target. Furthermore, the video recordings of the executed mission indicated that no civilians were present at the location.
In light of this, JIAT found that the procedures of the coalition in targeting the (building and its annexes) were in accordance with the International Humanitarian Law and its Customary Rules.
In relation to the port of (Al hudaydah) city
Regarding to the letter from the Coordinator of the Panel of Experts on Yemen, which stated that on (27 May 2018) an airstrike bombed the port of (Alhudeydah) city where seven commercial ships were anchored under the supervision of the United Nations.
JIAT verified the incident, examined all related documents, including the Procedures; Rules of Engagement, the Daily Mission Schedule, the After Mission Reports, the satellite images of the target location, the video footage of the executed mission; and assessed all gathered evidence.
JIAT found that based on intelligence reports that the Houthi armed militia is planning and sponsored by foreign experts to prepare (3) suicide boats to target ships in the International Water in the Red Sea. On (27 May 2018) the Coalition Forces to prevent the suicide boats from targeting the ships in the International Water in the Red Sea, executed an air mission on the targeted boats anchored in the port of (Alhudaydah), and hit its target.
After reviewing the video of the executed mission JIAT found that there were not any civilians in the targeted area, and the hit was direct. Also the report of the Coordinator of the Panel of the Experts on Yemen did not mention any damage to the commercial ships in the port.
In light of this, JIAT found that the procedures of the coalition in targeting the (3) suicide boats on the port of (Alhudaydah) were in accordance with the International Humanitarian Law and its Customary Rules.
In relation to the (civilian house) in (Mahalla) Village, Lahj Governorate
Regarding to the report issued by the Panel of Experts on Yemen stated that a civilian house hit by an airstrike on (25 May 2016) in (Mahalla) village in )Lahj( governorate, causing the destruction of the house, death of (6) people and injuring (4) others.
JIAT verified the incident, examined all related documents, including the Procedures; Rules of Engagement, the Daily Mission Schedule, the After Mission Reports, the satellite images of the target location, the video recordings of the executed mission; and assessed all gathered evidence.
JIAT found that based on intelligence reports from inside Yemen indicated a gathering of leaders of Houthi armed militia inside a specific (building), and accordingly lost its legal protection of civilian objects for the effective contribute in military action, which represents a high value legitimate military objective that its destruction achieves military advantage. The Coalition Forces executed an air mission at (03:25) am Wednesday (25 May 2016) on the (building) in (Mahalla) village in (Lahj) governorate. Furthermore, the video recordings of the mission confirmed that there were no civilians in the location.
In light of this, JIAT found the procedures of the coalition in targeting the (building) were in accordance with the International Humanitarian Law and its Customary Rules.
